Terms and Conditions of Posting Offers on www.powertochoose.org

Website Purpose:

  • As part of its ongoing Texas retail electric market customer education efforts, the Public Utility Commission of Texas (PUC) operates the www.powertochoose.org website, which provides customers an opportunity to learn about electric competition and to help customers make informed choices for electric service and retail electric providers. A Price Comparison Tool is part of the website and is intended to allow residential customers an unbiased and non-promotional grid where customers can view available offers.
  • Website Layout:

  • The PUC is the sole determiner of www.powertochoose.org’s design, data elements, layout, and format, including all aspects of the Price Comparison Tool, and reserves the right to modify any elements of the website and the Price Comparison Tool without prior notice.
  • Honoring Offers:

  • As a condition of posting offers on www.powertochoose.org, Retail Electric Providers (REP) are expected to honor the prices and all terms and conditions of products posted. REPs should immediately modify or delete all offers that have changed or are no longer available to customers. The PUC reserves the right to remove a REP’s offer(s) from the website and/or suspend access to the website if the REP fails to honor the posted prices or terms and conditions.
  • Terms and Conditions:

  • All offers posted on www.powertochoose.org are subject to the following terms and conditions. Additionally, failure to comply could result in the removal of offers from the website without advance notice and/or suspended access to the website.
    1. Any REP registered with the PUC may post limit of five (5) active plans per product type, (Fixed, Variable & Indexed). Each certificated REP or DBA can have 5 active plans per product type in each utility service territory.
    1. All REPs interested in posting offers will be issued a user-id and password, which permits the REP to submit such information through a web-based interface.
    1. Accurate and timely postings are the responsibility of the REP, and the PUC shall not be liable for inaccurate or untimely postings. The PUC reserves the right to pull postings where incomplete information has been provided or data entry errors exist.
    1. In order to ensure that offers are comparable, the PUC offers guidelines on how offers should be designated (i.e. fixed, variable, indexed, promotion, or prepaid) on the website. REPs are expected to follow these guidelines when entering information. The PUC reserves the right to remove offers that do not comply with these guidelines and/or suspend REP access to the website.
    1. All plans posted on powertochoose.org (English version) must also be made available on poderdeescoger.org (Spanish version) with all associated documentation, including Electricity Facts Labels and Terms of Service documents provided in Spanish. The PUCT reserves the right to inactivate any plan on powertochoose.org (English version) that does not mirror a plan on poderdeescoger.org (Spanish version). The reverse will also apply – i.e., all Spanish offers must have a mirrored English offer in order to remain active.
    1. The PUC reserves the right to remove offers without advance notice from the website and/or suspend access should the PUC believe that the information is inaccurate or can be construed as deceptive or misleading. For REPs that are removed and/or suspended from the website, the PUC may require pre-approval of future postings, on a schedule solely determined by PUC staff, as a condition of regaining access to the website
